"This tragedy happened because live bullets were brought to the set and the gun was loaded," said Luke Nikas, the famous actor's lawyer. Nikas went on to explain: Gutierrez-Reed did not carefully check the bullets and the gun. Halls did not carefully check the gun, even stating that it was safe before handing it to Baldwin. Zachry also did not disclose that Gutierrez-Reed acted irresponsibly off set and posed a safety risk to those around him. The attorney stated that Baldwin wanted to "clear his name" and hold the defendants responsible for their misconduct. According to the New York Times, Baldwin also accuses Kenney of "random" stockpiling of ammunition. The case file also cited the FBI report, which stated that Zachary and Gutierrez-Reed did not keep track of all live bullets on set. Baldwin caused the death of cinematographer Halyna Hutchins and the injury of director Joel Souza when the gun in her hand was fired on the set of Rust in New Mexico, USA on October 21, 2021.
