Epic Games won't back down: They will sue Apple again!

The ongoing dispute between Apple and Epic Games is escalating. Famously, Apple has a practice of taking a percentage cut from every transaction within its App Store, a policy informally labeled as the "Apple tax" by many industry professionals. Epic Games, the developers behind Fortnite Mobile, have taken issue with this policy, being reluctant to relinquish a substantial portion of their game's earnings to Apple under this "tax."

This disagreement propelled the two corporate giants to court, with each attempting strategic moves to gain the upper hand. In the initial legal tussle, Epic Games seemed to have an advantage, securing a 2021 win that permitted alternative payment methods outside Apple's platform. Nevertheless, subsequent appeals overshadowed this triumph for Epic.

Despite the High Court's decision upholding Apple's App Store guidelines, the fight is far from over. Epic Games has since approached the Supreme Court, challenging the previous antitrust verdict against Apple. According to Epic's submission, the 9th Circuit's decision was flawed, and they assert that Apple's existing App Store guidelines contravene federal antitrust statutes.

Central to Epic's argument is the claim that Apple exploits its monopoly over the App Store to impose elevated commissions on in-app transactions. Such actions, Epic contends, negatively affect both consumers and app developers. If the Supreme Court opts to revisit Epic's plea, it could signal a pivotal shift for both the App Store's future operations and the broader mobile app industry. Notably, Apple is also facing pressure from the European Union to liberalize its App Store protocols. However, the likelihood of Apple forgoing its significant revenue streams remains a matter of speculation.
